Welcome to GCash Partner Learning Management System (LMS).

Please read these terms and conditions (“Terms” or “Agreement”) carefully prior to completing your registration for an account with GCash Partner LMS. The following Terms shall govern how you may access and use the portal, the GCash Partner LMS Training Materials, GCash Website, and all other associated services (individually, “GCash Service” or collectively, “GCash Services”). By registering to GCash Partner LMS or using the portal, you accept and agree to be legally bound by these Terms and the terms of each and every GCash Training Material you are enrolling and accessing through the LMS.

Please also read the Privacy Policy of GCash and Acceptable Use Policy before using or gaining access on any, or a portion of, the GCash Partner LMS. The Privacy Policy describes the purpose and manner of collection and processing of your personal data when using the GCash Partner LMS portal while the Acceptable Use Policy defines the set of rules for your compliance when using the GCash Partner LMS portal. If you do not understand or do not wish to be bound by these Terms, the Privacy Policy, or the Acceptable Use Policy, you cannot access or use any of the GCash Partner LMS materials. You further acknowledge that you have fully understood and agree to be governed by the rules and regulations of each of the GCash Partner LMS portal services you are availing.

Any version of these Terms in a language other than English is provided for convenience, and you understand and agree that the English language version will control in case of any conflict in translation or meaning.

Under these Terms, the terms “GXI”, “GCash”, “we”, “us”, and “our” refer to G-Xchange, Inc. (GXI) including its directors, officers, representatives, partners, affiliates, successor and assigns. “User”, “you”, and “your” refer to the individual who uses the GCash Partner LMS Portal and registers for, and enrolls of the GCash Training Materials, and/or the GCash Partner LMS Services. 

GCash is duly registered with and licensed by the Bangko Sentral ng Pilipinas (BSP).

1. DEFINITIONS

1.1 “Biometrics” shall refer to the User’s measurement and analysis of unique physical or behavioral characteristics (such as the face, fingerprint, or voice patterns), especially as a means of verifying personal identity.     

1.2 “Cash-in” shall refer to the process of loading cash into the GCash Wallet.

1.3 “Cash-out” shall refer to the process of withdrawal of cash from GCash Wallet.

1.4 “Claims” shall refer to all kinds of claims, demands, losses, costs, expenses, damages, or liabilities of any kind, suits, actions, assessments, judgments, payments, fines, interest, penalties, and other charges, including all reasonable attorneys’ fees and costs of investigation, litigation, settlement, or judgment. 

1.5 “GCash” shall also refer to a form of electronic money (“e-money”) that allows Users who registered to GCash Service to easily and conveniently send and receive cash as well as make payments electronically.

1.6 “GCash Accredited Merchant” shall refer to an establishment that accepts either GCash or GCash Card or both as payment for the purchase of goods and services.

1.7 “GCash App” shall refer to the GCash mobile application running on mobile devices where the User can avail of the GCash Service or make use of the GCash Wallet.

1.8 “GCash Partner LMS” shall refer to the GCash Training Portal running on web and mobile browsers where the User/Partner/Merchant can enroll on the required and provided trainings available

1.9 “GCash Card” or “Card” shall refer to a prepaid card linked to a GCash Wallet which can be used for online purchases, Point-Of-Sale (“POS”) purchases, and Automated Teller Machine (ATM) cash withdrawals. The card is also accepted by accredited merchants worldwide.

1.10 “GCash Group” shall refer to (i) GXI, (ii) its affiliates and subsidiaries, including Globe Telecom, Inc., Globe Fintech Innovations, Inc., and Fuse Lending, Inc.; (iii) GXI’s business partners, service providers, and other third-party partners contracted by it for the purpose of conducting its business operations; and (iv) their respective shareholders, directors, officers, employees, agents, representatives, assigns, and anyone acting under their direction or in their behalf.

1.11 “GCash Wallet” or “GCash Account” shall refer to an e-money instrument that stores Philippine Peso (Php) value which resides in the GCash system. It is an account that is linked to the User’s mobile Subscriber Identity Module (SIM) card and which may or may not be evidenced by a physical GCash Card. Functionalities include, but are not limited to, transfer of funds, payments of goods and services, over-the-air reload of airtime, and balance inquiry.

1.12 “GCash Website” shall be used to officially represent GCash on the internet, where visitors may register to create an account. Users are also provided with information about products and services.    

1.13 “Know Your Customer” or “KYC” shall refer to the process of establishing the identity of the User as required by the BSP, also known as Customer Verification.

1.14 “Mobile Personal Identification Number” or “MPIN” shall refer to the four (4)-digit security personal identification number of, and nominated by, the User that is used for all GCash transactions. It is also used for both POS and ATM transactions.

1.15 “One Time Pin” or “OTP” shall mean an automatically generated numeric or alphanumeric string of characters that is sent to the registered mobile number of the user to authenticate a certain transaction or login session.

1.16 “Personal Data” refers to the same term defined under the Data Privacy Act of 2012 (Republic Act No. 10173) and the Implementing Rules and Regulations of the Data Privacy Act of 2012.

1.17 “Personal QR/P2P QR / Transfer QR” shall refer to a specific QR code associated with the GCash account that allows Send Money transactions.

1.18 “Peer-to-Peer/Person-to-Person (P2P) Express Send” shall refer to the existing send money service which allows a GCash Sender to send money to a GCash Receiver.

1.19 “Short Message Service” or “SMS” shall mean a communications protocol allowing the interchange of short text messages between mobile telephone devices. This includes the SMS or E-receipt sent to User’s GCash App inbox.

1.20 “Unstructured Supplementary Service Data” or “USSD” shall mean the protocol used by telecommunications companies to communicate with the service provider’s computers.

1.21 “Unauthorized Transaction” shall mean when an account is compromised without providing any confidential information (answers to security questions, MPIN, and/or OTP) that may lead to the access of a User’s account.     

2. ACCOUNT SECURITY

2.1 You shall keep your GCash Partner LMS portal credentials, OTP, and other GCash Account data confidential and secure at all times. These shall not be disclosed to anyone. You shall be responsible for the security of your GCash Partner LMS portal credentials. All activities made using the GCash Partner LMS portal credentials provided to you are conclusively presumed made by you, and you shall be liable therefor.

2.2 You agree to assume full responsibility and liability for all activity made in your GCash Account. You acknowledge and agree that your credentials are known only to you and as such, any activity using your credentials and/or OTP shall be presumed to be done by you. 

2.3 You agree that GCash, at its sole discretion, is entitled to act on the instructions received from you through the GCash Partner LMS Portal or web facility after the entry of your credential (username and password) and OTP authentication. You shall hold GCash free and harmless from any Claims arising from the use of your credentials or OTP, unless such Claims are directly due to the gross negligence of GCash. 

2.4 The security and proper care of the GCash Partner LMS Account, as well as the confidentiality of your username, password and OTP shall be your sole responsibility.

2.5 In case you forget your username or password in the GCash Partner LMS portal, you shall immediately raise a support ticket within the website. You agree that GCash shall temporarily deactivate your GCash Partner LMS account until you request activation. All transactions made prior to the report of forgetting password shall continue to be the liability of the User. You shall hold GCash free and harmless from any Activities arising from the loss of your account credentials.     

3. GCASH PARTNER LMS PORTAL

The GCash Partner LMS is a browser-based training portal. It will not perform any other transactions and have any other purpose except for providing regulatory trainings, assessments, and product-related trainings. However, it is subject to the rules and regulations of the BSP, the Anti-Money Laundering Act (AMLA), as amended, and the Data Privacy Act of 2012, its implementing rules and regulations, and other related laws, rules, and regulations.

4. ACCESS AND USE

4.1 Provision of Access. Once enrolled, GCash will grant you a non-transferrable access in the GCash Partner LMS Portal for a maximum period of thirty (30) days from the time of registration. Your access will automatically expire thirty (30) days after activation and may only be reactivated upon your request, subject to GCash’s approval.

4.2 Use Restrictions. You shall not use the GCash Services for any purposes beyond the scope of the access granted in this Agreement or the Acceptable Use Policy. You shall not, at any time, directly or indirectly, copy, modify, or create derivative works of the GCash LMS Training Materials, in whole or in part, or use the GCash IPR for any purpose other than those specified under this Terms.

4.3 Suspension, Deactivation, and Reactivation. Without liability, GCash has the prerogative and authority to suspend or deactivate your use or access to GCash Partner LMS Services or GCash Services whenever it deems appropriate and necessary. If GCash deactivates your account, you may request for its reactivation, subject to GCash’s approval.

5. REPRESENTATIONS AND WARRANTIES

5.1 You represent and warrant that you are at least eighteen (18) years old and have the legal capacity to agree with these Terms.

5.2 If the GCash Partner LMS Portal are for the use and benefit of a business entity, you also represent and warrant, in addition to the above, that: (1) you are duly authorized by your company to do business and agree and be bound to these Terms on behalf of your company; and (2) all officers, employees, representatives, and agents of your company that are using or accessing the GCash Partner LMS Portal are duly authorized by your company to use and access the GCash Partner LMS Services and GCash Services.     

6. DISCLAIMER

6.1 GCash makes no warranty, express or implied, regarding GCash Partner LMS Services and the GCash Services.

6.2 The GCash Partner LMS Services are offered on an “AS IS” and “AS AVAILABLE” basis without warranty of any kind. GCash makes no warranty: (1) as to the quality or accuracy of transactional data or information received or transmitted using the GCash Partner LMS Portal; (2) as to any training material or service obtained using the GCash Partner LMS Portal; (3) that the GCash trainings or services will be uninterrupted or error-free; or (4) that any particular result or information will be obtained. You acknowledge and agree that any access to or use of the GCash LMS Services or GCash Services is at your own risk.

7. LIMITATION OF LIABILITY

You release GCash from any and all claims related to these Terms, including those Claims arising from the use of your credentials, unless such Claims are directly attributable to GCash’s gross negligence. GCash shall not be subject to any rights or Claims from third parties and shall not be held liable for damages caused by any act or omission by a third party.

8. MISCELLANEOUS

8.1 These Terms shall be effective from the time of your registration, activation, or usage of the GCash Partner LMS portal and will exist up to the time that it is terminated by you or us, save for those terms and conditions that by its nature shall survive termination of these Terms.

8.2 GCash reserves the right to modify these Terms at any time without any prior notice. Any changes to these Terms will be effective immediately upon posting on this page, with an updated effective date. By accessing or using the GCash LMS portal after any changes to these Terms have been made effective, you signify your agreement on a prospective basis to the modified or revised Terms. Kindly periodically visit this page to ensure familiarity with the latest version of the Terms.

8.3 The GCash Partner LMS Account may not be assigned, transferred, or used by any person other than you.

8.4 If any provision of these Terms is declared invalid, the other provisions shall remain valid and effective to the extent permitted by applicable laws.

8.5 Philippine laws shall govern these Terms and any dispute arising from these Terms shall be brought before the courts of Taguig City to the exclusion of all other courts.

8.6 If GCash requires the services of counsel or a third-party service provider to enforce any of its rights and remedies under the Agreement, it shall be entitled to recover from you attorney’s or service provider’s fees, and to the extent permitted by law, fines and penalties, if any.

8.7 If you use GCash Partner LMS, you consent to your personal data being collected, shared, and disclosed to the service providers of GXI necessary to provide the GCash Partner LMS function to you. This information includes name, mobile number, chat messages, and transaction reference ID once a transaction is successfully completed. The processing, sharing, and use of your personal data shall be governed by GXI’s Privacy Notice.
